1. Introduction

Welcome to Badger: Operation Gamify ("Platform"), a service provided by Summon AI LLC ("Company", "we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of our website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

2. User Accounts

To use certain features of our Services, you must create an account. You are responsible for safeguarding your account information. You agree that you are solely responsible for all activities or actions that occur under your account, whether or not you have authorized such activities or actions. Summon AI LLC is not liable for any loss or damage arising from your failure to comply with this requirement.

3. User Conduct and Content

You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links, and other content or materials (collectively, "Content") that you submit, post, or display on or via our Services.

You agree not to post violent, nude, partially nude, discriminatory, unlawful, infringing, hateful, pornographic, or sexually suggestive photos or other content via the Service. You also agree not to engage in any activity that is illegal or unauthorized.

4. Commander and Subscription Terms

Users may upgrade to a "Commander" account, which allows for the creation and monetization of missions. Commanders are responsible for the content they create and for moderating submissions from other users. Revenue generated from subscriptions and paid missions is subject to platform fees and processing fees by our payment processor, Stripe.

5. Rewards System and Commander Liability

The Platform includes a feature allowing Commanders to offer digital or physical rewards ("Rewards") to users for completing missions. You acknowledge and agree that Summon AI LLC is not the party offering these Rewards. We are solely a facilitator providing the technology for Commanders to create, manage, and redeem these Rewards.

Commanders are solely responsible and liable for the fulfillment, quality, value, and legality of any Rewards they offer. Summon AI LLC makes no warranties or representations about any Rewards and expressly disclaims all liability for any claims, damages, or losses arising from your interaction with or use of any Reward offered by a Commander. Any disputes regarding a Reward must be resolved directly between you and the Commander.

6. Intellectual Property

The Services and its original content, features, and functionality are and will remain the exclusive property of Summon AI LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Summon AI LLC.

7. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8. Limitation of Liability

In no event shall Summon AI LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect.
